(Burlington, NC)  --  On August 16, 2012 at 12:50am The Burlington Police Department responded to a report of a trespasser at 728 North Church Street. Officers located Derrick Franklin Penland a short distance away.

As Officers approached Penland to investigate, he threw a large amount of clothing on the ground. Penland was detained and officers determined that the Maxway on N. Church St had been broken into and the clothing that Mr. Penland discarded was taken from Maxway.

Derrick Franklin Penland b/m 46 of Chandler Ave. Burlington N.C. was then arrested for the following offenses:

1) Felony Breaking and Entering of a Business
2) Injury to Real Property

Penland was issued a $11,000 secure bond and his first appearance in court will be 08-16-2012 at 2:00pm.
