Montgomery, N.C. - Candor commissioner and state trooper Wayne Holyfield didn't appear in court last week. As a result, dozens of cases were dismissed.

Several of those cases were DWIs. In other words, twelve people arrested for driving while intoxicated got a pass because Holyfield didn't show up to court.

The district attorney's office says the highway patrol did not serve a subpoena to Holyfield that was issued by the district attorney's office.

News 2 discovered ten of the twelve DWI offenders had no other major offenses in Montgomery County. One of those individuals had been arrested before for a DWI. Another man had quite an extensive criminal history. The man had faced charges for: underage drinking, drug paraphernalia, hit and run, reckless driving, leaving the scene of an accident, communicating threats, assaulting a female and first degree kidnapping.

And, there are multiple cases where Holyfield is supposed to testify at in the future. Right now, the district attorney's office is exploring all options about how to handle this situation. But, the district attorney's office told us it doesn't understand why the highway patrol didn't serve Holyfield with the subpoena to appear in court.
