Commissioner Found Not Guilty Of Boating DWI

Lexington, NC -- A judge found Davidson County commissioner Todd Yates not guilty of operating a boat while impaired on High Rock Lake.

Judge Mark Galloway said Yates was not guilty of the DWI charge, along with refusing to allow inspection and driving a motorboat in a no-wake zone.

Galloway also dropped charges of resisting an officer.

The judge said there was no evidence that Yates was impaired while driving the boat. Galloway also cited conflicting testimonies about the boat inspection and the fact that the boat could not travel fast enough to kick up wake as reasons for his decision.

Davidson County's chief judge requested that Galloway come in from another district to hear the case.
