
Caswell County, NC-- Tuesday morning John Fuqua had another day in court. Fuqua was charged in September with assault with a deadly weapon.
According to investigators Fuqua shot at a neighbor during an argument as three Caswell county children were walking down the road. Two of them were hit with shotgun pellets. Fuqua was served with two felony assault warrants after the incident but his bond was only $5,000 which caused an outrage. He posted that bond within the hour of his arrest and went home.
Fuqua bond was increased the following Monday, to $130,000 after he was charged with more felonies. Fuqua remains free on bond.
In a statement released to the media Thursday, the NAACP had this to say about the case so far: Three 12-gauge shotgun blasts were fired in the direction of three children -- two ten year olds and one seven year old -- on Brown Road south of Yanceyville, N.C. around 4:40 p.m. on Saturday, September 5th. Two of the children were seriously wounded by the blasts.
There is evidence the use of this deadly weapon was motivated by race. The parents of the injured children requested the NC State Conference of NAACP Branches and the Caswell NAACP Branch to monitor law enforcement's handling of the investigation and prosecution of the crime. The NC NAACP notified the U.S. Attorney General of our interest in the case and is conducting its own investigation.
On October 13, 2009, the man charged with the shootings, Mr. John Clyde Fuqua, appeared in Court. Trial was set for February 22, 2010.
Also on October 13, 2009, the State of North Carolina presented evidence to the Grand Jury to support three additional charges against Mr. Fuqua: Assault with a Deadly Weapon with Intent to Kill. Since Grand Jury proceedings are secret we do not know what evidence was presented. The Grand Jury declined to indict Mr. Fuqua, at this time, with the new charge.
The NC NAACP will report on the case to the National NAACP Board of Directors meeting this weekend".
John Fuqua has so far denied WFMY News 2's request for an interview about the incident.
